1: CONSIDERATIONS

The company Mind Makers Editora Educacional Ltda. (“MIND MAKERS”) maintains an application available to users involved in courses owned by Mind Makers, whether as school, franchise, facilitator or student administrators. Through this application these users consult and/or update information about classes. This application is not sold separately, but is intended exclusively to support teaching and learning activities by these users.

2: DEFINITIONS

App or mobile application: it is software developed to be installed on a mobile electronic device, such as a cell phone, a smartphone. This application can be installed on the device, if the device allows and provided it is downloaded by the user through an online store, such as Google Play or App Store.

Android: operating system for mobile devices, developed by the '' Open Handset Alliance '', led by Google.

iOS: is a mobile operating system from Apple Inc. originally developed for the iPhone.

Geolocation: it is a system capable of locating mobile devices such as, but not limited to, cellular devices, in order to detect when such mobile terminals (and therefore their users) are geographically close to a certain geographical point or within a certain defined region through a virtual fence called “geofence”. And in this way they can offer functionalities or send messages. Such georeferenced messages (geolocalized alerts) can serve several purposes including, for example, sending promotional messages from commercial establishments;

Camera: mobile devices are equipped with a camera that allows the recording of photos and videos, and an application can directly access this camera when there is an interest in directly capturing photos or videos that are destined to its database;

Microphone: mobile devices are equipped with a microphone that allows speech to the cell phone and also the capture of sounds in videos, and an application can directly access the microphone when there is an interest in capturing videos;

School-Client: Company that provides educational services, which has a contract to use Mind Makers content.

3: AUTHENTICATION POLICY AND PROFILE INFORMATION

In order for the user to be able to download the application on his mobile device, he must first make sure he has Android or iOS. After downloading the application, the user must authenticate using a username and password provided by Mind Makers or by a School-Client. There is no collection of personal information, automatic registration, nor disclosure of information registered internally to unauthorized users, through the MIND MAKERS application.

4: GEOLOCALIZATION POLICY

The MIND MAKERS application uses georeferencing solely to allow users of the application to change the color of the nearby school facade, a playful functionality used to exemplify Internet of Things (IoT) resources. Such location information is not stored or passed on to third parties.

5: CAMERA AND MICROPHONE USE POLICY

The MIND MAKERS application uses direct access to the camera and microphone to capture photos and videos of student presentations made during the execution of projects in the classroom, in order to allow the products created by the teams to be registered on the project page and in the students' portfolio. students in the app, creating memory of students' and school's achievements.

Such project records promote technical collaboration between geographically dispersed students, being accessible only by registered users of the application, who participate as administrators, facilitators or students of Mind Makers courses.

6: INTELLECTUAL PROPERTY

The user agrees that the Service provided by Mind Makers, including, without limitation, the MIND MAKERS application with its user interface, scripts and software used to implement it, contains exclusive information and material that are the property of MIND MAKERS and are protected by intellectual property laws and other applicable laws, including, without limitation, copyright.

No part of the Services may be reproduced in any way or by any means, except as expressly permitted. You agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the MIND MAKERS application in any way, and you must not exploit the MIND MAKERS application in any unauthorized manner, including, without limitation, by invasion or overload of network capacity.

THE USE OF THE SOFTWARE OR ANY PART OF THE SERVICES, EXCEPT FOR THE USE OF THE MIND MAKERS SERVICE, IS STRICTLY PROHIBITED AND INFRINGES THE INTELLECTUAL PROPERTY RIGHTS OF THIRD PARTIES, AND MAY SUBJECT YOU TO CIVIL AND CRIMINAL PENALTIES, INCLUDING ALL TERMS AND CONDITIONS.
